Southwest Fair Housing Council Announces $25,000 Settlement in Race Discrimination Case

TUCSON, AZ - [9/8/2026] - Southwest Fair Housing Council (SWFHC) announces the resolution of a fair housing matter involving an apartment resident who alleged that race affected how property management and maintenance personnel treated him. The disputed claims were resolved through a $25,000 settlement without a finding of liability.
According to the complaint, the tenant reported multiple problems during his tenancy, including a stairway railing near his apartment that he asked management to repair. The complaint alleged that the repair was not made and that the tenant later fell, injured his foot, required physical therapy, and missed work.
The complaint also described additional conflicts with maintenance personnel and property management. The tenant alleged that his race affected the way staff responded to and interacted with him. After he moved from the property and filed a housing discrimination complaint, the matter was referred to mediation and ultimately settled for $25,000.
"Fair housing protections do not end once a lease is signed," said Tasha Lynch, Manager of Operations and Investigations at SWFHC. "Tenants are entitled to have repair requests, complaints, and interactions with housing staff handled without race affecting the response."
Fair housing protections apply throughout a tenancy, not only when a person applies for housing. Discrimination may affect repairs, responses, enforcement of property rules, interactions with staff, fees and charges, lease renewals, access to amenities, and decisions about ending a tenancy.
Not every maintenance dispute is housing discrimination. A fair housing concern may arise, however, when race or another protected characteristic affects the treatment a tenant receives. Unequal responses to comparable repair requests, rules, or complaints can be relevant when evaluating whether discrimination occurred.
SWFHC encourages tenants to retain repair requests, emails, photographs, text messages, dates of conversations, and notes about interactions with housing staff when they believe discrimination may be occurring. Information showing how comparable requests from other tenants were handled may also be important.
